1. How to File a DMCA Takedown Notice
If you believe that any user-uploaded content or illustration generated through our platform infringes upon a copyright that you own or represent, please deliver a written notice containing all of the following statutory requirements (17 U.S.C. § 512(c)(3)):
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered, a representative list of such works.
- Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (such as the specific URL, Order Number, or image link).
- Information reasonably sufficient to permit Rawy to contact you (including your full name, mailing address, telephone number, and email address).
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
2. Takedown & Response Timeline
Upon receipt of a bona fide, complete infringement notice meeting the statutory criteria above, Rawy will:
- Promptly disable access to or remove the identified material within 24 to 48 business hours.
- Forward a copy of the notification to the affected customer or account holder.
- Inform the customer of their statutory right to file a Counter-Notification.
3. Counter-Notification Procedure
If a customer believes their material was removed or disabled by mistake or misidentification, they may submit a Counter-Notification pursuant to 17 U.S.C. §§ 512(g)(2) and (3) containing their contact details, statement under penalty of perjury, consent to jurisdiction, and signature. If a valid counter-notice is received, Rawy may reinstate the material within 10-14 business days unless the original complainant files a court action.
4. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, Rawy has adopted a strict policy of terminating, in appropriate circumstances, accounts and access for users who are found to be repeat infringers of intellectual property rights.
